Indeed Insider Terms of Service

These Indeed Insider Terms of Service (“Insider Terms”) incorporate the Indeed Terms of Service. By using Indeed Insider in any way, by participating in Indeed Insider as an employer (“Employer”), or by accessing a survey provided by Indeed Insider (“Survey Participant”), you agree to these Indeed Insider Terms and the Indeed Terms of Service. Any capitalized words that are used but not defined in these Indeed Insider Terms have the meaning set forth in the Indeed Terms of Service (the “Agreement”). The word “You” refers to the Employer or Survey Participant, or anyone using the Site in accordance with the context of the sentence. Any term applicable to an Employer in the Indeed Terms of Service shall also apply to an Employer under the Insider Terms.

  1. The Program

    Use of or participation in the Indeed Insider Program (“Program”) is subject to all applicable Indeed terms and policies, including without limitation the Indeed Privacy Policy (https://www.indeed.com/legal#privacy) and those instructions provided on the Site. Indeed policies may be modified at any time. The Program is a beta product, and use of or participation in the Program is subject to the terms applicable to beta products in the Agreement.

    If you are an Employer participating in the Program, you represent and warrant that you have reviewed the content of any survey provided by Indeed Insider (“Survey”) and you request that Indeed provide the Survey to your employees at the email addresses you provide. You further represent and warrant that the email addresses you provide to Indeed belong to your company's current employees, and that each email address corresponds to one employee. You represent and warrant that any such email address will be provided to Indeed in good faith and that you will not select specific employees to take the Survey in a manner that may result in misleading or deceptive Survey results or in a manner that may otherwise violate any applicable laws.

    An Engagement Survey is a survey of Employees which measures Employee engagement and sentiment. Employee responses to an Engagement Survey are presented to the Employer on a de-identified basis. Indeed does not publish the responses to an Engagement Survey.

    The Company Page Survey comprises two parts 1) private feedback to management (“Private Feedback”), and 2) all other answers, which comprise of a review that may be made public (“Public Review”). The Employer may elect whether to make public on the Site all or none of the Public Reviews provided in the Company Page Survey. However, all Public Reviews are still subject to Indeed's content moderation policies, and whether reviews are published on the Site or removed from the Site is in Indeed's sole discretion. For clarity, this means that even if an Employer elects to publish the Public Reviews on the Site, Indeed may, in its sole discretion, not publish or remove some or all of the Public Reviews on or from the Site. A review may also be removed if the Survey Taker who wrote the review decides to remove it from the Site. Indeed may indicate on its Site that an Employer has participated in the Program and has elected to publish the Survey results. In some cases, the job title and location associated with a Public Review or Private Feedback may be generalized (for example, if there is a limited number of employees with the same title and/or location). You agree that you will not retaliate against any Survey Taker in any way related to their participating in the survey, including but not limited to, because they took the Survey or the content of their answers to the Survey.

    If you are a Survey Participant, and you already have an Indeed account associated with the email to which you received the survey invitation, your Survey answers will be associated with your account. If the Survey does not ask for your job title and location, your job title and location will be provided by your employer and appended to your review. If you do not have an Indeed account, an account will be created for you, and your Survey answers will be associated with the account. You represent and warrant that you are a current employee of the Employer company. You understand and agree that the Public Review you include when you answer the Survey may be posted on the Site. The Employer will decide whether to make all or none of the Public Reviews publicly available on the Site, subject to Indeed's User Content policies and discretion. Indeed removes your name and email address from the Survey answers provided to the Employer, but Indeed does not guarantee that the Employer won't be able to ascertain your identity from your review or Survey answers. You further understand that your review constitutes your User Content as defined in the Indeed Terms of Service and that your review must comply with the rules outlined in such terms.

  2. Disclaimer and Limitation of Liability

    Indeed assumes no responsibility, and disclaims all liability, for the content, accuracy, validity, completeness, legality, reliability, or availability of the Program or Site. Indeed disclaims any and all liability for any claim arising from or related to User Content, including but not limited to inaccurate information, misstatements, or misrepresentations provided by any user of the Program or Site or any online or offline conduct or misfeasance of any user of the Program or Site. Indeed further disclaims any liability that arises as a result of the emails Indeed sends to Survey Takers, as instructed by the Employer.

  3. Indemnification

    You agree to defend, indemnify and hold harmless Indeed from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your violation of any term of the Insider Terms or Agreement; (b) your use of, and access to, the Program or Site; (c) your loss of, or disclosure of, information gained from using the Program or the Site; (d) your violation of any applicable laws or regulations; (e) your violation of any third party right; (f) any claim that your content caused damage to a third party; or (g) your actions as an Employer or Survey Taker. You also agree that you have a duty to defend Indeed against such claims. You agree that this indemnity extends to requiring you to pay for Indeed's reasonable attorneys' fees, court costs, settlements and disbursements. This defense and indemnification obligation will survive the Insider Terms, Agreement, and your use of the Program.

  4. Termination

    The Program is a beta product, and Indeed may cancel all or part of the Program or features and functionalities thereof anytime, in our sole discretion, without prior notice.

    We may suspend your access to the Program, the Site, your account, or any other provision of tools to you, and we may terminate the Insider Terms agreement with you, at our sole discretion, at any time, with or without notice. If you wish to terminate the Insider Terms agreement, you may do so by notifying Indeed at any time.

    All provisions of the Insider Terms, which by their nature should survive termination shall survive termination, including, without limitation, warranty disclaimers, indemnity and limitations of liability.
